Eavesdropping on the phone calls of U.S. citizens; demands by the FBI for records of library borrowings; establishment of military tribunals to try suspected terrorists, including U.S. citizens--many of the measures taken by the Bush administration since 9/11 have sparked heated protests. In Not a Suicide Pact, Judge Richard A. Posner offers a cogent and elegant response to these protests, arguing that personal liberty must be balanced with public safety in the face of grave national danger.

Critical of civil libertarians who balk at any curtailment of their rights, even in the face of an unprecedented terrorist threat in an era of proliferation of weapons of mass destruction, Posner takes a fresh look at the most important constitutional issues that have arisen since 9/11. These issues include the constitutional rights of terrorist suspects (whether American citizens or not) to habeas corpus and due process, and their rights against brutal interrogation (including torture) and searches based on less than probable cause. Posner argues that terrorist activity is suigeneris--it is neither "war" nor "crime"--and it demands a tailored response, one that gives terror suspects fewer constitutional rights than persons suspected of ordinary criminal activity. Constitutional law must remain fluid, protean, and responsive to the pressure of contemporary events. Posner stresses the limits of law in regulating national security measures and underscores the paradoxical need to recognize a category of government conduct that is at once illegal and morally obligatory.

理查德·波斯纳,先后以最优生和年级第一名毕业于耶鲁大学英文系(1959)和哈佛大学法学院(1962)。曾任美国联邦最高法院大法官助理、联邦政府律师、斯坦福大学法学院副教授(1968)、芝加哥大学法学院教授(1969)和讲座教授。1981年出任美国联邦第七巡回区上诉法院法官至今(1993-2000年任首席法官),同时担任芝加哥大学法学院高级讲师。 波斯纳是法律经济学的主要创建者之一;同时也是“法律与文学”和实用主义法学的领军人物。他的著作众多,辐射广泛,有所谓“一个人的智库”之称;他的法律学术和实践重塑了美国的法学和法律。“他是著述最丰的联邦法官,前无占人。任职上诉法院,仍属最高产的法学家之列,同样前无古人。如果以引证率测度影响力,那么当仁不让,波斯纳是在世的最有影响的法学家。”(劳伦斯.莱西格语)

译者 苏力,少年从军,当过工人、政府雇员。毕业于北京大学法律系(学士,1982);1985年读研究生期间赴美留学,先后获LL.M(McGeorge)、M.A.和Ph.D(ArizonaState)学位。1992年起任教于北京大学法学院;现任北京大学法学院教授、院长,长江学者。
